1. Our Commitment to Food Safety

At Di Sucre by V, food safety is a fundamental priority. Our team is trained in proper food handling procedures and strictly follows all applicable local, state, and federal food safety regulations. All staff members use appropriate protective equipment including gloves, hair nets, and sanitized utensils. All preparation surfaces, equipment, and packaging materials are food-grade and regularly sanitized.

 


 

2. Allergen Disclosure

Our products may contain or come into contact with the following common allergens recognized by the FDA under the Food Allergen Labeling and Consumer Protection Act (FALCPA) and the FASTER Act of 2021:

  • 🥜 Peanuts & Tree Nuts — including almonds, walnuts, pecans, cashews, and pistachios

  • 🌾 Gluten / Wheat — present in most baked goods

  • 🥛 Dairy — milk, butter, cream, and cheese

  • 🥚 Eggs

  • 🫘 Soy

  • 🐟 Fish & Shellfish — including shrimp, crab, and lobster

  • 🌱 Sesame

By placing an order, the customer confirms they are aware of these potential allergens and assumes full responsibility for any allergic reaction or adverse health outcome.

3. Gluten-Free & Special Dietary Options

We take extra care with every gluten-free and special dietary order. Before preparing any such order, our team thoroughly cleans and sanitizes the entire work area — including surfaces, utensils, and equipment — to minimize the risk of cross-contact.

Despite these precautions, our kitchen is a shared facility where gluten-containing and other allergen-containing ingredients are used daily. We cannot guarantee a 100% gluten-free, nut-free, or allergen-free environment.

Customers with celiac disease, severe gluten intolerance, or life-threatening allergies should carefully consider this risk before ordering. Di Sucre by V shall not be held liable for any reaction resulting from cross-contamination despite our sanitation efforts.

4. Limitation of Liability

All sales are final at the point of pick-up or upon dispatch for mailed orders. Once an order has been collected at the drive-thru window or handed to a shipping carrier, Di Sucre by V assumes no responsibility for any adverse reactions, illness, injury, dissatisfaction, or damages — direct or indirect — arising from the consumption or handling of our products.

This policy applies to all transactions made through this website, at our physical drive-thru location, and all orders shipped by mail, without exception.

To the maximum extent permitted by applicable law, Di Sucre by V, its owners, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from the purchase, consumption, or handling of our products.

For in-person pick-up orders:

  • Liability ends at the moment the order is received at the drive-thru window.

  • No refunds, exchanges, or replacements will be issued after pick-up.

For mailed orders:

  • Di Sucre by V is not responsible for delays, damage, spoilage, or changes in product quality caused by shipping carriers or transit conditions.

  • Once a package has been handed to the carrier, we cannot guarantee the condition, temperature, or integrity of the product upon arrival.

  • No refunds or exchanges will be issued once a mailed order has been dispatched.

  • Customers assume all risk associated with ordering perishable food items by mail.

 


 

5. Customer Acknowledgment & Agreement

By completing a purchase — whether online, in person, or by mail — the customer expressly acknowledges and agrees that:

  1. They have read, understood, and accepted this Allergen & Food Safety Policy in its entirety.

  2. They have disclosed any relevant allergies or dietary restrictions to Di Sucre by V prior to ordering when applicable.

  3. Di Sucre by V is not liable for any allergic reaction, illness, injury, or adverse outcome occurring after the product has left our facility — whether picked up in person or shipped by mail.

  4. No refunds, replacements, or compensation will be provided after pick-up or after a mailed order has been dispatched.

  5. For mailed orders, product quality and condition after transit is beyond our control once the package leaves our facility.

  6. This agreement is binding regardless of the purchase channel used.

 


 

6. Indemnification

By purchasing from Di Sucre by V, the customer agrees to indemnify, defend, and hold harmless Di Sucre by V, its owners, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to the customer's purchase, consumption, or use of our products, or any violation of this policy.

 


 

7. Governing Law

This policy shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from or related to this policy shall be subject to the exclusive jurisdiction of the courts located in Hays County, Texas.
